A motion to dismiss the first-degree murder case against 19-year-old Charles William Curtis Thompson has been denied.
Sixth District Judge Sean McPartland denied the defense’s motion to dismiss the charge Thursday during a final pretrial conference.
McPartland ruled the defense did not show sufficient evidence to prove the prosecution intended to cause a mistrial during Thompson’s initial trial in September. The mistrial occurred after the prosecutors played portions of an interview with Thompson they had previously agreed not to present in court.
Thompson was charged in October 2009 in connection with the slaying of Broadway landlord John Versypt.
His retrial is scheduled to begin on Dec. 5 in the Johnson County Courthouse.
