The case of the material witness held in connection with the Oct. 8, 2009, shooting death of John Versypt has been dismissed, according to court records.
Justin Marshall, 19, was in the apartment building where Versypt, the landlord of Broadway Condominiums, was shot during a checkup on the residence.
Police investigators questioned Marshall on the day of the shooting, but further interviews with him did not match his original story, authorities have said.
Marshall’s lawyer, Sarah Majerus, filed a motion for dismissal on Feb. 8 on the basis that holding her client was unconstitutional.
On Feb. 11, Iowa City police arrested Charles William Curtis Thompson and charged him with first-degree murder in connection with Versypt’s slaying.
