Jonathan “Jack” McCaffery, 17, son of Iowa men’s basketball coach Fran McCaffery, was sentenced Monday for failing to yield to a pedestrian, a simple misdemeanor.
McCaffery was scheduled to have his sentencing in November, but in a court filing Monday, his lawyer waived that sentencing hearing. In the filing, his lawyer also wrote that McCaffery would not resist the state’s recommendation for his punishment, which was a $1,000 fine and 180-day driver’s license suspension.
The charge stems from a car accident on May 22 at Melrose Avenue and Kennedy Parkway in which McCaffery’s car hit Corey Hite, 45, an Iowa National Guard Sgt. First Class from Cedar Rapids.
According to witness testimony from McCaffery’s trial in August, in which he waived the right to appear, Hite was jogging across a busy road after a driver in one car signaled for him to cross. As he was crossing, McCaffery’s car came driving down the road, and the two collided despite McCaffery applying the brakes.
“He started jogging across and he never stopped and looked to see if there were any cars coming in the left lane,” Lynn Wright, a witness during the trial, said in her testimony. “[McCaffery] hit the brakes when he was hitting the guy but it was too late.”
The filing from Monday concludes with attorneys for McCaffery and Johnson County requesting the courts to enter the sentencing as put forth in the filing and to cancel next month’s hearing and any other “relief deemed appropriate.”
