Hawkeye QB Derby charged with criminal mischief, public intox

Iowa quarterback A.J. Derby was arrested on the night of Oct. 1 near Iowa City and charged with fourth-degree criminal mischief and public intoxication.

According to a criminal complaint filed in the Johnson County Courthouse, deputies responded to a call at Wildwood Smokehouse & Saloon, 4919B Walleye Drive S.E., at 11:23 p.m. that an "uninvited intoxicated" male punched out the window of a bus as he exited it.

The deputy who reported to the scene approached Derby after witnesses identified him as the person who punched the window, the complaint said. Derby admitted to punching out the window and said he would pay for it. The complaint said Derby had "watery, red eyes, slurred speech, and smelled of ingested alcohol."

He submitted to a preliminary breath test, which indicated he had a blood-alcohol concentration of .120, according to the complaint.

The 20-year-old Derby was released early Sunday morning after posting bond, a Johnson County Jail clerk told The Daily Iowan.

Fourth-degree criminal mischief is a serious misdemeanor in which the cost of replacing or repairing the damage is more than $200 but less than $500. It is punishable by up to a year in prison and a fine of between $250 to $1,500.

As of Sunday evening, Iowa head coach Kirk Ferentz had yet to comment on the incident.
